Job Context:
∎ Democracy International (DI) is implementing USAID`s Promoting Peace and Justice activity, which works with legal aid delivery organizations, justice sector actors, and vulnerable groups to improve access to and delivery of services in Bangladesh. As part of this effort, it is working to develop a written Resource for Adjudicators of Cases of Crimes of Gender-Based Violence (GBV) in partnership with the United States Department of Justice`s Office of Overseas Prosecutorial Development, Assistance, and Training (OPDAT) and USAID`s Fighting Slavery and Trafficking in Persons (FSTIP) activity.
∎ The objectives of the Resource for Adjudicators of Cases of Crimes of GBV are to:
∎ Support the judiciary in applying the existing legal framework related to crimes of GBV, both substantively and procedurally, in a manner which is expeditious, uniform, and in-line with established precedent and international conventions to which Bangladesh is party.
∎ Promote a victim-sensitive approach to GBV cases that reduces the likelihood of revictimization and fosters an environment of truth seeking; and
∎ Reinforce the principles of a fair trial, especially as they relate to the right to legal aid.
∎ The Resource for Adjudicators of Cases of Crimes of GBV will consist of two parts: 1) a practical manual for judges adjudicating cases of GBV, to include sections on a victim-sensitive approach to GBV cases, principles of a fair trial in GBV cases, and resources available to GBV victims in Bangladesh; and 2) a SuperSummary Guide on the Suppression of the Nari o Shishu Nirjatan Daman Ain, 2000, which will include the relevant case law and practice guidance on key procedures and sentencing.
∎ An advisory committee will serve over the development of the Resource for Adjudicators of Cases of Crimes of GBV are to, consisting of representatives from the Supreme Court of Bangladesh, the Ministry of Law, Justice, and Parliamentary Affairs (MOLJPA), the Federal Courts of the United States, OPDAT, FSTIP, and PPJ.
∎ The Resource for Adjudicators of Cases of Crimes of GBV will be launched in Bangla in May 2023. Print copies will be made available to all members of the Bangladesh judiciary adjudicating cases related to GBV and a digital version will be publicly available.
∎ Position Summary: Democracy International seeks the services of an expert to develop and write a Super Summary Guide on the Nari o Shishu Act. The expert will be responsible for developing and drafting the contents of the guide and incorporating feedback from the Advisory Committee. The expert must have extensive knowledge of the Nari o Shishu Act and have excellent Bangla writing skills.
∎ Reporting: This position reports to the Chief of Party
∎ Position Type: Consultant

Job Responsibilities:
∎ Visit 5 pre-determined districts and research available support services through both in-person and virtual means.
∎ Develop a list of the available social service organizations,
∎ Visit the identified social service organizations and provide information on legal aid and seek their permission to be included in the directory.
∎ Collect relevant information to be included in the directory in a clear and organized fashion, including (to the greatest extent possible) telephone number, point of contact, address, and services provided.
∎ Qualifications

Additional Requirements:
∎ Extensive knowledge of the Nari o Shishu Act in theory and practice.
∎ Strong academic writing skills.
∎ Fluency in Bangla and the ability to work in English.
∎ Experience developing legal guidance for judges is an advantage.
∎ Outline of the SuperSummary Guide on the Nari o Shishu Act with sufficient detail to allow the Advisory Committee to easily understand which precedents and guidance will be included in the final draft (due within 3 weeks of contract signing).
∎ A first draft of the SuperSummary Guide on the Nari o Shishu Act, incorporating the inputs provided by the Advisory Committee for the outline (due within 4 weeks of receiving feedback on the outline).
∎ A final draft of the SuperSummary Guide on the Nari o Shishu Act, incorporating the inputs provided by the Advisory Committee for the initial draft (due within 2 weeks of receiving input on the initial draft).
∎ Comments and suggested revisions on the English translation of the SuperSummary Guide on the Nari o Shishu Act (due within 2 weeks of receiving the translated copy).

Compensation & Other Benefits:
∎ It is expected that the Legal Expert will work no more than 50 days on this assignment for a 6-month period following the signing of the contract. While travel is not anticipated, any pre-authorized travel expenses will be paid in accordance with DI's official policy.
