Experience:
Bar Council Enrollment.
Minimum 3 to 6 years experience, preferably in healthcare, insurance, labour law, or corporate legal practice.
Working within a legal department, private practice specializing in healthcare law, or in-house hospital legal team.
Ability to independently and accurately interpret patient privacy and health information policies; analyze complex legal issues.
Excellent written and verbal communication skills; ability to produce formal correspondence and legal documents; communicate complex legal concepts clearly to non-legal staff.
Strong negotiation skills; ability to de-escalate challenging situations; empathy when communicating with distressed patients, families, or staff.
Exceptional time management; ability to work under pressure and meet tight legislative deadlines.
High accuracy in processing legal requests, maintaining records, and ensuring compliance.
Proficiency in Microsoft Office applications.
Ability to work with minimal supervision and take initiative.
A. Medico-Legal & Information Release
Process Legal Requests: Receive, assess, and process all medico-legal requests including subpoenas, police requests, solicitors' letters, and court orders for release of patient health information.
Financial Dispute: Provide legal advisory support to management if any financial dispute arises by the patient party.
Privacy Compliance: Ensure all information releases comply with relevant privacy legislation and hospital policies.
Subject Access Requests: Manage Subject Access Requests from patients seeking copies of their medical records, ensuring legislative timelines are met.
Consent Verification: Verify appropriateness of requests, confirm patient consent, conduct identification checks, and maintain accurate records of all disclosures.
B. Claims & Litigation Support
Advisory Support: Provide legal advisory support to the authority if any conflict arises between patient party and hospital administration or consultants or other stakeholders and suggest further steps.
Case Management: Manage a caseload of clinical negligence claims and personal injury claims, including statement preparation, analysis of expert evidence, and coordination with insurers.
Coronial Inquests: Coordinate hospital involvement in coroner's inquests, including reviewing evidence, preparing staff for testimony, attending hearings, and supporting witnesses.
External Counsel Liaison: Liaise with external advocates, insurers, and courts on litigation matters; track case progress, costs, and outcomes.
Incident Review: Review incident reports and adverse event investigations to assess medico-legal exposure and support risk management strategies.
C. Contract Review & Legal Documentation
Contract Drafting: Draft, review, and negotiate a wide range of hospital contracts, including service agreements, supplier contracts, consultancy agreements, MOUs, and partnership agreements.
Contract Register: Maintain a central legal contract register with key terms, expiry dates, and risk flags.
Policy Development: Assist in drafting and reviewing hospital policies, procedures, and consent frameworks to ensure legal compliance.
D. Regulatory Compliance & Risk Management
Healthcare Regulations: Advise on compliance with healthcare regulations.
Data Protection: Support compliance with data protection laws, advising on data breaches and mitigation actions.
Governance Support: Provide legal advisory support to management committees and contribute to clinical governance and quality improvement initiatives.
E. Employment & Labor Relations Support
Advisory Role: Advise management on disciplinary cases, grievances, terminations, consultant complaint and appeals in line with employment laws and collective bargaining agreements.
Dispute Resolution: Support management in labor disputes and conciliation proceedings.
F. General Legal Advisory & Administrative Duties
Legal Research: Conduct legal research and analysis to support various legal matters including compliance, risk management, and potential litigation.
Stakeholder Communication: Respond to inquiries from internal departments, external agencies, and regulatory bodies.
Training: Provide advice and guidance to clinical and administrative staff on medico-legal issues, privacy obligations, and documentation standards.
