Educational Requirements:
∎ Bachelor degree in civil/structural engineering
∎ Additional degree/diploma in a discipline like construction management/ contract management/ business studies etc.
Experience Requirements:
∎ 20 to 25 year(s)
Job Responsibilities:
∎ Acting as the key contact point for contractual matters with the contractors from initial discussions to delivery of the project
∎ Discussing, reviewing and negotiating the form and terms of the contract (following approval of owner)
∎ Managing schedule and budget
∎ Working with 3rd parties to ensure that everyone understands their role and responsibilities
∎ Communicate contract related issues to all stake holders
∎ Dealing with any unexpected costs that may exceed those agreed in the budget
∎ Together with the construction manager attending site meetings to monitor progress and making sure the project meets agreed technical standards
∎ In close collaboration with the financial team, managing the final invoicing process
∎ Liaising with internal (construction manager, QC manager, CFO, CEO) and external parties including contractor's representatives and sub-contractors
∎ Analyze the contract terms and identify areas of possible risks and opportunities related to the application of contract clauses.
∎ Quantify the risk value and be able to provide mitigating contractual language / article project related solutions to minimize the risk.
∎ Successfully negotiate contracts with customers with compelling arguments.
∎ Safeguard company's contract objectives.
∎ Manage and coordinate (at headquarter/site Company Level) contract administration activities, providing contract administration resources to bids and projects, ensuring that all aspects of the contract during the bidding and execution phase are addressed with the objective of contributing to maximize project revenues.
∎ Assist with the bid handover and booking process and ensure that the necessary commercial information is understood and disseminated to the extended project team.
∎ Establish and maintain the project variation control system and managing negotiations in line with contract requirements.
∎ Ensure compliance with the project specific contractual administration requirements.
∎ Provide advice, assistance and guidance to management, project managers and functions on project specific contractual matters.
∎ Ensure commercial risks are identified and managed across the project scopes of work by controlling the overall project risk and opportunity review and reporting process.
∎ Support periodic client and internal reporting and performance presentations.
∎ Support the formulation and negotiation of project contractual claims and counter claims.
∎ Work closely with in-house financial team concerning all financial aspects including variations, valuations and ensuring overall control of cost and complete and agree final accounts
∎ Provide and keep the owner/ owner's representative and the in-house team apprised with all necessary information on a weekly/ fortnightly/ monthly basis in appropriate agreed formats
∎ Oversee submittal of as-built drawings and O&M manuals by the contractor
Additional Requirements:
∎ Ideally s/he should have 20-25 years professional experience in civil engineering projects (high rise buildings would be an advantage) with a minimum of 5-7 years of progressive responsibility with quantifiable results in contract negotiation, administration and/or management
∎ Experience in managing projects valuing Tk 100.0 crore or above. Oversea work experience or experience with foreign contractors/ consultants in Bangladesh is desirable.
∎ Commercially, financially and contractually aware with good communication, inter-personal & negotiation skills, establish and administer contracts
∎ Full understanding and working knowledge of all aspects of lump sum and reimbursable project related financial and contractual management clauses in areas such as but not limited to Application of Rates, Confidentiality, Completion Notices, Payment Profiles & Cashflow, Variation Control, Escalations, Cancellation etc. required to make sound ITO commercial decisions.
∎ Understanding of key commercial risks and areas for opportunity and able to lead project risk review process and assessments
∎ Ability to negotiate to secure favourable outcomes, having the flexibility to understand and negotiate alternative contractual and commercial positions with contractors (subject to approval)
∎ Excellent analytical and critical thinking abilities
∎ Ability to multitask, prioritize, and manage time efficiently
∎ Accurate and precise attention to detail
∎ Computer skills in Microsoft Outlook, Word, Excel, Power Point; scheduling software such as MS Project, Primavera or Other
